Lawyers representing Afghan villagers caught up in Operation Burnham have just filed proceedings with The High Court in Wellington against the NZ Defence Force.

Details were revealed in the book Hit and Run by Nicky Hager and Jon Stephenson.

The lawyers are representing three clients and say it's unfair there was no independent inquiry.

They are asking for the High Court to decide whether an independent inquiry into the operation in Afghanistan should have taken place.

Lawyer Deborah Manning says they can't say whether they have new information to present to the court.

They expect a hearing in the next six months.
